У статті проаналізовані сучасні вимоги законодавства України до процедури добору кадрів в органи місцевого самоврядування. Особливості проведення перевірок щодо кандидатів на посади місцевого самоврядування показано у світлі законодавства про очищення влади та боротьбу з корупцією. Визначені актуальні проблемні питання, з якими стикаються кадровики при прийнятті на роботу претендентів на посади "ззовні" та при переведенні державних службовців, або прирівняних до них посадових осіб. Запропоновані шляхи вдосконалення добору кадрів на службу в органах місцевого самоврядування.

У статті розглянуто місто з точки зору соціального порядку від класичних соціальних теорій до сьогодення. В основу покладено погляди Георга Зіммеля, механістична теорія Мамфорда Льюїса, ідея розподілу праці Дюркгейма та місто як продукт культури Макса Вебера, за допомогою яких автор аналізує міську реальність Анрі Лефевра, соціум спектаклю Гі Дебора та протиставлення стратегії та тактики в містах Мішеля де Серто. Поняття «соціальний порядок» стосується визначених обмежень, заборон та контролю у суспільній житті; має на увазі існування взаємин у суспільстві; включає в себе (...) елемент передбачуваності та повторюваності у суспільному житті; може означати визначену узгодженість компонентів соціального життя; відзначає стійкість, більш чи менш тривале збереження її форми. На ґрунті переосмислення міського життя зроблена спроба переосмислити соціальний порядок, що є дотичним ідеям етнометодології. Метою статті є деталізація концепту міста в контексті конституювання та функціонування соціального порядку та окреслення підстав для розвитку цього аспекту в етнометодології Гарольда Гарфінкеля та його послідовників. A set of reals is universally Baire if all of its continuous preimages in topological spaces have the Baire property. ${\sf Sealing}$ is a type of generic absoluteness condition introduced by Woodin that asserts in strong terms that the theory of the universally Baire sets cannot be changed by set forcings. The ${\sf Largest\ Suslin\ Axiom}$ is a determinacy axiom isolated by Woodin. It asserts that the largest Suslin cardinal is inaccessible for ordinal definable surjections. Let ${\sf LSA}$ - ${\sf (...) over}$ - ${\sf uB}$ be the statement that in all generic extensions there is a model of $\sf {LSA}$ whose Suslin, co-Suslin sets are the universally Baire sets. We outline the proof that over some mild large cardinal theory, $\sf {Sealing}$ is equiconsistent with $\sf {LSA}$ - $\sf {over}$ - $\sf {uB}$. In fact, we isolate an exact theory that is equiconsistent with both. As a consequence, we obtain that $\sf {Sealing}$ is weaker than the theory “ $\sf {ZFC}$ + there is a Woodin cardinal which is a limit of Woodin cardinals.” This significantly improves upon the earlier consistency proof of $\sf {Sealing}$ by Woodin. A variation of $\sf {Sealing}$, called $\sf {Tower \ Sealing}$, is also shown to be equiconsistent with $\sf {Sealing}$ over the same large cardinal theory. We also outline the proof that if V has a proper class of Woodin cardinals, a strong cardinal, and a generically universally Baire iteration strategy, then $\sf {Sealing}$ holds after collapsing the successor of the least strong cardinal to be countable. This result is complementary to the aforementioned equiconsistency result, where it is shown that $\sf {Sealing}$ holds in a generic extension of a certain minimal universe. This theorem is more general in that no minimal assumption is needed. A corollary of this is that $\sf {LSA}$ - $\sf {over}$ - $\sf {uB}$ is not equivalent to $\sf {Sealing}$. (shrink)

The research is devoted to the ethical views of Vladimir Monomakh, reflected in the “Teaching” of the Grand Duke. The author’s reflections concerning such fundamental moral categories as good and evil, virtue and vice, the meaning of life and death, free will, duty, happiness are considered and analyzed. A partial continuity of the Grand Duke’s views concerning the relationship to the categories of good and evil, as well as virtue and vice, with the Byzantine Christian tradition, in particular with regard (...) to the “theory of three small deeds”, which is based on the theory of repentance of John Chrysostom, and the theory of “asceticism in the world”, based on the writings of Basil the Great. It is revealed that the ethical views of the Grand Duke do not fit into the strict paradigm of Christian medieval philosophy and theology. In this regard, the author of the article draws attention to the syncretic nature of the worldview of the author of the “Teaching”, expressed in a kind of worldview combining Christian and pre-Christian beliefs. In this vein, the specific understanding of the problems of the meaning of life, death, happiness by Vladimir Monomakh is analyzed, which is revealed when considering the peculiar attitude of the author of the “Teaching” to the sacred rites of prayer and burial. The author’s views on the category of duty in the universal and state terms, as well as the principles of practical behavior, are studied. According to the results of the research, the author of the article comes to the conclusion that the work of the Grand Duke is an ethical “micro-treatise”, the ideological content of which fully reflects the moral concept of the existence of the ancient Rus-sian man. The research is based on a study of short story collections by Israeli writer Ida Fink’s, All the Stories, and French writer Charlotte Delbo’s, Auschwitz and After, to reflect the impact of the Holocaust on autobiographical elements in their work. The authors are representatives of the first generation of Holocaust survivors, which means that the mass systematic genocide during World War II was a personal traumatic experience for them. The works of female writers are studied using the theory of trauma (...) at the genre level. Since autobiography has been considered a documentary genre with its own peculiarities, works about the Holocaust were seen as historical evidence of this event. However, based on the works of Juri Lotman and some principles of Philippe Lejeune’s “autobiographical pact”, we can conclude that autobiography is similar to fiction if it can meet certain aesthetic functions. Under the influence of trauma, the genre of autobiography can be modified in the literary text in such a way that the line between autobiography and fiction is blurred. Ida Fink and Charlotte Delbo write short stories with fictional narrators, but all the situations are certainly the experiences of the writers themselves, who turn to the autofiction and conventions of Philippe Lejeune’s “autobiographical pact” to transfer their memories to literary heroes. The aim of the study is to define the peculiarities of the autobiographical genre, analyze its functions in Holocaust literature, identify poetic elements of autobiography, and prove that there is no canonical form of narration about the Holocaust-Era, as the writers were searching for how to articulate their traumatic experience in experimental forms. The article is devoted to the transformation of traditional folk culture archetypes of wood, stone, thread in modern decorative and applied art, as well as ways of using threads, wood and stone as materials for the manufacture of objects of modern art. The research does not aim to repeat classical ethnographic studies or to refer monographs on the history of culture. The article is an attempt at a comprehensive analysis of the modern practice of decorative and applied art from the (...) point of view of the philosophy of culture and practical aesthetics. This approach is a unique experience in the analysis of jewelry and decorative practices of processing heterogeneous materials of natural origin. The cluster of masters of decorative and applied art in Russia is expanding, there are more and more opportunities and materials for creativity, but the authors of the products themselves are not engaged in stylistic, art criticism or philosophical understanding of their activities. Nevertheless, their works, according to researchers, reflect the oldest mythological images that are the cornerstones of Russian culture and represent the heritage of world culture, transformed by post-culture and man-made trends that have penetrated, among other things, into art. Archetypes of wood, stone, thread, preserved since ancient times, acquire new meanings and new forms of embodiment in the works of modern authors. (shrink)

In this paper, we show that the failure of the unique branch hypothesis for tame iteration trees implies that in some homogenous generic extension of [Formula: see text] there is a transitive model [Formula: see text] containing [Formula: see text] such that [Formula: see text] is regular. The results of this paper significantly extend earlier works from [Non-tame mice from tame failures of the unique branch bypothesis, Canadian J. I analyze in this article the different ways in which Descartes uses abstraction in the Regulæ, discussing his project of a mathematical physics, the role of the imagination, and the status of numbers. I also try to show that the doctrine of simple natures cannot be well accommodated with the theory of abstraction developed in Rule 14, having instead a greater affinity with Descartes’ later theory of abstraction and exclusion, in which imagination plays no role and everything happens at a (...) strictly intellectual level. This interpretation is supported by the recent discovery of the Cambridge manuscript, which almost certainly records an early stage of composition and in which the doctrine of simple natures is absent, thus being very probably a later development. Existing scholarly work on corporate social responsibility frequently emphasizes either normative/ethical claims about social progress or instrumental/strategic claims about corporate effectiveness, yet less often acknowledges the moral conditions of those undertaking CSR within a specific cultural context. In this paper, we draw attention to the social conditions in which CSR takes place and the related ethics of the subjects that must enact it. Our approach is to document the lived experiences of practitioners in Romania, a post-communist society. Drawing from fifty-three (...) depth interviews with both corporate responsibility practitioners, and managers in non-profit organizations who together work on CSR projects, we describe their experiences of the social and organizational environment, the CSR practices that are undertaken in this context, and the intended and unintended consequences of such work. Using Bauman’s theorization of ethics, including adiaphora and moral distancing, and Borţun’s interpretation of Romanianness, we then theorize liquid CSR as an ambivalence between adiaphoric practice and the moral impulse to do good, resulting in both intended and unintended consequences. The article examines the impact of Georges Bataille’s philosophy on Hijikata Tatsumi’s butoh dance. Bataille’s understanding of dance as unproductive expenditure, the concepts of inner experience and communication are being reconsidered and incorporated in choreographic language of Hijikata, extending his technical and conceptual tooling. Bataille defines dance as an expenditure given in a form of sign. The butoh dance-experience is functioning as a metaphor of a speculation, created by a movement. It is experienced by dancers and spectators as an execution.

How can it be that some acts of very high moral value are not morally required? This is the problem of supererogation. I do not argue in favor of a particular answer. Instead, I analyze two opposing moral intuitions the problem involves. First, that one should always do one’s best. Second, that sometimes we are morally allowed not to do our best. To think that one always has to do one’s best is less plausible, as it makes every morally best (...) act obligatory. I argue that, despite its implausibility, this is the main ingredient in a traditional outlook I call ‘morality of law,’ which conceives of morality as impartial, impersonal, rule-based and obligation-based. My main point is that supererogation will always be seen as problematic if the background theory is a morality of law. This is because supererogation encapsulates a view of morality-outside-obligation, whereas morality of law centers upon obligation as its main instrument of curbing a supposedly natural human selfishness. The subject of the study is the connection between the absurd and phenomenology.The texts of representatives of the absurdist trend in literature and philosophy (Camus, Kafka, Musil), as well as the works of academic philosophers of the phenomenological direction (Husserl, Sartre, Merleau-Ponty, Fink) are considered. The commonality of phenomenological interpretations of reality for some texts of the absurdist genre is proved. As a hypothesis, the existence of an epistemological dimension of meaning in the works of the absurd is put forward, (...) interpreted by the author as a reception of the views of phenomenologists, problematized in the inconsistent reduction of phenomena. The methodological basis was the general scientific methods of analysis and synthesis, as well as the critical analysis of the text. The scientific novelty lies in the attempt to present phenomenology as a precursor of absurdism, connected with it through the sphere of axiology. The main contribution of the author is the actualization of the epistemological layer of such a multifaceted phenomenon as the absurd, namely, the elaboration of the hypothesis that in many works of absurdists, the metamorphoses of the characters' consciousness are in fact an inconsistent reduction consisting in explicit metamorphoses of the Ego, as well as violating subject-object relations but not actually bracketing the idea of the world. Many literary contemporaries of Husserl devote their thoughts to the problems of phenomenology to one degree or another, which makes the connection between absurd literature and the key theses of early phenomenology logical. The purpose of this paper is to outline some recent progress in descriptive inner model theory, a branch of set theory which studies descriptive set theoretic and inner model theoretic objects using tools from both areas. There are several interlaced problems that lie on the border of these two areas of set theory, but one that has been rather central for almost two decades is the conjecture known as the Mouse Set Conjecture. One particular motivation for resolving MSC is that (...) it provides grounds for solving the inner model problem which dates back to 1960s. There have been some new partial results on MSC and the methods used to prove the new instances suggest a general program for solving the full conjecture. It is then our goal to communicate the ideas of this program to the community at large. (shrink)

Building on the work of Schimmerling [Coherent sequences and threads, Adv. Math.216 89–117] and Steel [PFA implies AD L, J. Symbolic Logic70 1255–1296], we show that the failure of square principle at a singular strong limit cardinal implies that there is a nontame mouse. The proof presented is the first inductive step beyond L of the core model induction that is aimed at getting a model of ADℝ + "Θ is regular" from the failure of square at a singular strong (...) limit cardinal or PFA.
